Elements of a Burn Injury Lawsuit
The elements of a burn injury lawsuit depend on the facts. Most burn injury lawsuits are based on negligence, which involves the careless actions or inactions of another. The four elements of negiligence are as follows:
- Duty
- Breach of Duty
- Direct or Proximate Cause
- Injury
Each of the above elements has to be proven by a preponderance of the evidence.
